Purchase Terms
Thank you for choosing The Mosaic Shop. We appreciate the opportunity to be part of your project.
Decorative mosaics, natural stone, and artisan tile materials bring depth, texture, and individuality to interior spaces. These materials are unique by nature and often involve specialized installation practices and logistical considerations. The following Purchase Terms are intended to provide helpful guidance so that customers, designers, installers, and contractors understand the characteristics of the materials being selected and the responsibilities involved in ordering and installation.
By placing an order with The Mosaic Shop, the purchaser acknowledges and agrees to the policies described below.
01
Order Acceptance
All orders are subject to review and acceptance by The Mosaic Shop. Order confirmations issued through the website acknowledge receipt of the order but do not constitute final acceptance.
We reserve the right to cancel or modify an order in the event of pricing inaccuracies, inventory discrepancies, payment issues, or suspected fraudulent activity. Once an order has been confirmed and processed, materials are prepared for shipment promptly and cannot be placed on hold for future delivery.
02
Product Representation, Natural Variation, & Material Characteristics
Tile, stone, and decorative mosaic materials are architectural surfaces that may naturally show signs of wear through use. These materials are not warranted against chipping, surface crazing, cracking, or other changes that may occur after delivery, installation, or normal use.
Both handcrafted and precision-manufactured tiles may display variation in size, shape, color tone, warpage, moisture absorption, surface finish, texture, and slip resistance characteristics. These variations are part of the production process and contribute to the distinctive character and visual richness of decorative tile surfaces.
Differences in color or appearance may also occur between samples, showroom displays, product photography, and the material supplied for a specific order.
Natural stone is formed through geological processes and therefore does not produce identical pieces. Individual stones may contain unique features such as veining, tonal variation, mineral deposits, fossils, pits, or other natural markings. These characteristics contribute to the individuality of the material and are not considered manufacturing defects.
Variation may also occur across a variety of decorative mosaic materials, including glaze variation, handmade tiles and moldings, ceramic, porcelain and terrazzo materials, cement tiles, gem and shell mosaics, brass and bronze metal tiles, river pebbles and other natural stones, and glass mosaics.
These characteristics are natural and are not considered product defects.
03
Product Imagery and Renderings
The Mosaic Shop may use photography, lifestyle imagery, and digital renderings to represent product appearance and installation concepts. These images are intended to provide a general visual representation of the material, including overall color palette, layout, scale, and design aesthetic.
While every effort is made to ensure imagery is as accurate as possible, photographs and renderings are illustrative in nature and should not be interpreted as exact representations of the material supplied. Variations in color, veining, texture, movement, finish, pattern, and scale may occur between product imagery, samples, and the final material received.
Because many of our products are natural or handcrafted, variation is inherent and contributes to the individuality of each installation.
Customers are encouraged to review physical samples prior to purchase to better understand the material’s characteristics and variation.
04
Ordering Guidance
For the best project results, customers are encouraged to order all required material at one time. Natural stone and many decorative tile materials may vary between quarry blocks, manufacturing runs, or production batches. Additional material ordered later may differ slightly in tone, veining, or overall appearance.
Because many of our products are produced in limited runs or sourced internationally, certain materials may require extended lead times. Special order and custom materials may require approximately 10–12 weeks for production, importation, and fulfillment, though estimated lead times may vary depending on product availability, country of origin, customs processing, and freight conditions.
Customers are encouraged to plan accordingly and confirm lead times prior to placing an order, particularly for time-sensitive projects.
Add-on orders may also result in project delays, product unavailability, and additional freight or handling costs.
05
Project Measurements and Quantity Verification
Accurate measurements and quantity calculations should always be verified by the installer or project contractor prior to placing an order.
While The Mosaic Shop may assist with preliminary quantity estimates, these estimates are provided as a courtesy and should be confirmed by the installation professional responsible for the project.
Tile installations require cutting and fitting during installation. To allow for cuts, waste, and future repairs, it is recommended that customers order a minimum 20% additional material beyond the calculated installation area.
06
Pre-Installation Layout and Blending
Tile and natural stone materials often display variation in tone, pattern, and surface movement. To achieve the most balanced and visually cohesive installation, materials should be mixed from multiple boxes during the installation process.
Prior to setting the tile, installers should remove the material from its packaging and arrange the pieces to preview the overall blend and layout. This allows the installer, homeowner, or design professional to review the distribution of color and pattern before installation begins.
Taking the time to review the material in this way helps ensure the finished installation reflects the intended design vision and makes the most of the natural variation within the material.
07
Installer Selection and Project Responsibility
The Mosaic Shop supplies decorative tile and mosaic materials but does not perform installation services or contract installation work.
From time to time, customers may request installer recommendations. Any installer names provided are shared as a courtesy based on prior customer experiences and should not be interpreted as endorsements or guarantees of workmanship.
The selection, hiring, and supervision of the installer is the sole responsibility of the purchaser. Installations should follow recognized industry guidelines, including those published by the Tile Council of North America (TCNA) and the Natural Stone Institute.
08
Project Suitability and Design Responsibility
The Mosaic Shop provides decorative tile and mosaic materials for use in a wide variety of interior and exterior applications. While our team may offer general guidance regarding material characteristics, final determination of a product’s suitability for a particular installation or environment remains the responsibility of the purchaser, installer, architect, or design professional involved in the project.
Factors such as substrate conditions, installation methods, environmental exposure, maintenance practices, and intended use may influence the long-term performance and appearance of tile and stone materials. These conditions are beyond the control of The Mosaic Shop.
Customers, installers, and design professionals are encouraged to review material specifications, consult with qualified installation professionals, and confirm that the selected material is appropriate for the intended application prior to installation.
The Mosaic Shop cannot be responsible for project outcomes related to material selection, design decisions, or installation conditions once the material has been delivered and installed.
09
General Guidance Disclaimer
From time to time, The Mosaic Shop may offer general guidance regarding product selection, installation methods, material applications, or installer recommendations. This information is provided as a courtesy to assist with project planning and should be considered informational in nature.
Such guidance does not constitute professional advice, design services, or installation instruction, and should not be relied upon as a substitute for consultation with qualified design professionals, contractors, or installers.
Final decisions regarding product selection, installation methods, and project execution remain the responsibility of the purchaser and their project team. The Mosaic Shop assumes no liability for outcomes related to the use or interpretation of such guidance.
10
Material Inspection Prior to Installation
After delivery, all materials should be opened and inspected prior to installation to confirm that the material meets project expectations.
Because installers work directly with the material before installation begins, the purchaser is responsible for ensuring that their installer or contractor reviews the material and confirms its suitability for the project prior to installation.
Claims related to shipping damage must be reported to The Mosaic Shop within 24 hours of delivery, along with photographs of the damaged materials and packaging.
If shipping damage is not documented at delivery or reported within this timeframe, the shipment will be considered accepted and replacement materials may become the responsibility of the purchaser.
Installation of the material constitutes acceptance of the product as received.
11
Natural Stone Performance and Care
Many natural stone materials are porous and may react to environmental conditions, sealers, or cleaning products. Depending on the stone selected, surfaces may develop staining, etching, mineral deposits, or natural patina over time.
Proper sealing and maintenance are important for preserving the appearance of natural stone surfaces. Harsh or acidic cleaners should be avoided, as they may damage certain stone finishes.
Because installation methods, jobsite conditions, and maintenance practices are outside our control, The Mosaic Shop cannot be responsible for changes that occur to natural stone surfaces after installation.
12
Order and Payment for Stock Items
Payment for in-stock items is due in full at the time an order is placed.
For materials that are temporarily out of stock but expected to return to inventory, a 50% deposit may be required to reserve the material. The remaining balance will be collected once the material arrives at our warehouse and prior to shipment.
Orders not paid in accordance with these terms may be considered abandoned after ninety (90) days. Materials associated with abandoned orders may become the property of The Mosaic Shop and refunds may not be issued.
Sales tax applied at the time of purchase is based on current tax rates and regulations and may be adjusted prior to shipment in accordance with applicable state and local tax requirements. The final tax amount will be calculated at the time the order is prepared for shipment and will be reflected on the final invoice. The purchaser is responsible for any difference in tax due resulting from changes in tax rates or jurisdictional requirements between the time of order and shipment.
All payment obligations are subject to the terms outlined in The Mosaic Shop’s Return Policy and Cancellation Policy.
Once an order has been placed, any applicable cancellations, modifications, or returns will be governed by these policies. Payment for materials does not override or alter the conditions under which an order may be cancelled, returned, or deemed final.
Customers are encouraged to review the Return Policy and Cancellation Policy prior to placing an order to understand eligibility requirements, applicable fees, and timeframes associated with order changes or returns.
Prices for additional material ordered at a later date will reflect the current pricing in effect at the time of reorder.
13
Order and Payment for Special Order Items
All special-order materials must be paid in full at the time the order is placed. Special orders are produced or sourced specifically for the purchaser and are not eligible for cancellation or return once production or procurement has begun.
Special order materials are often sourced from overseas or produced specifically for the purchaser. As a result, additional freight charges may apply beyond standard domestic shipping.
These costs may include transportation from the country of origin to The Mosaic Shop’s warehouse, as well as delivery from our warehouse to the final project location. Freight charges will vary depending on the product, origin, order size, and delivery destination.
Any applicable freight charges will be communicated prior to final processing whenever possible. The purchaser is responsible for all freight costs associated with special order materials.
Prices for additional material ordered at a later date will reflect the current pricing in effect at the time of reorder.
14
Tariffs and Import Duties
Certain products offered by The Mosaic Shop may be sourced internationally and may be subject to tariffs, import duties, or other government-imposed fees.
These charges are determined by applicable regulations at the time of import and are subject to change without notice. Any increases in tariffs or related fees that occur after an order is placed but prior to shipment may result in additional costs.
The purchaser is responsible for any applicable tariffs, duties, or related charges associated with their order.
15
Delivery and Shipment Inspection
All pallets, crates, and cartons should be carefully inspected and counted at the time of delivery before the bill of lading is signed.
Customers or their designated representatives are responsible for examining the shipment for any visible damage to packaging, pallets, or containers. If damage is observed, it must be clearly noted on the bill of lading before signing for the delivery. Signing the delivery receipt without documenting damage indicates that the shipment was received in acceptable condition.
Any visible damage should be photographed and reported to The Mosaic Shop in writing within 24 hours of delivery. If damage is reported within this timeframe and properly documented, our team will assist by submitting a claim with the freight carrier on the customer’s behalf.
16
Shipping Responsibility and Risk of Loss
All orders are carefully packaged and prepared for shipment prior to leaving our facility. Once an order has been released to the freight carrier, responsibility for the shipment transfers to the purchaser.
While The Mosaic Shop is not responsible for damage, loss, or delays that occur during transit, we are committed to assisting our customers throughout the process. In the event of shipping damage, our team will work with the customer to submit a claim with the carrier, provided that all delivery inspection and reporting requirements outlined in these Purchase Terms are followed.
Timely inspection and proper documentation at the time of delivery are essential to ensure that any freight-related issues can be addressed effectively.
17
Returns, Cancellations, and Order Changes
Stock orders may be cancelled or modified prior to shipment. Customers requesting changes to an order should contact The Mosaic Shop as soon as possible so our team can assist before materials are prepared for shipment.
Special orders, custom products, and made-to-order materials are processed specifically for the purchaser and may not be cancelled or modified once procurement, production, or order processing has begun.
Once an order has shipped, it becomes subject to The Mosaic Shop’s Return Policy.
Return requests must be submitted within 30 days of delivery and require a Return Authorization issued by The Mosaic Shop prior to returning any material. Approval of returns is at the sole discretion of The Mosaic Shop.
All returned materials must be unused, in original packaging, and in condition suitable for resale. Upon receipt, returned materials will be inspected to confirm eligibility.
Refund amounts, if approved, will be determined after inspection of the returned material and may be adjusted based on the condition of the product. Materials that are damaged, incomplete, or not suitable for resale may be denied or subject to partial refund at our discretion.
Original shipping charges are non-refundable, and customers are responsible for return freight costs unless otherwise approved by The Mosaic Shop.
Certain items, including special orders, custom products, and materials that have been cut or installed, are not eligible for return.
Because tile installations require additional material for cuts and waste, customers are encouraged to verify project measurements and order sufficient overage prior to purchase. A general guideline is 15% additional material, though some patterns and layouts may require more depending on size and installation complexity. Customers should consult with their installer to determine the appropriate quantity for their specific project.
For full details regarding return eligibility, restocking requirements, and the return authorization process, please refer to our complete Return Policy.
19
Pricing and Website Accuracy
While every effort is made to ensure product information and pricing accuracy, The Mosaic Shop reserves the right to correct errors related to pricing, product descriptions, or availability.
If a pricing or listing error is discovered after an order has been placed, customers will be contacted to review the corrected information prior to processing the order.
20
Warranties and Limitation of Liability
The Mosaic Shop offers decorative tile and mosaic materials sourced from a range of manufacturers and artisans. Any applicable warranties are provided solely by the original manufacturer, where available. Except for such manufacturer warranties, The Mosaic Shop does not provide additional warranties of any kind.
To the fullest extent permitted by applicable law, all implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement, are expressly disclaimed.
Because many of the materials we offer are natural or handcrafted, variation in appearance, texture, and performance is inherent to the product and should be expected. These characteristics are not considered defects and do not constitute a basis for claims, replacements, or refunds.
The Mosaic Shop shall not be liable for any labor costs, installation expenses, project delays, loss of use, or any indirect, incidental, or consequential damages arising out of or related to the purchase, delivery, installation, or use of our products.
In the event that a claim is reviewed and approved by The Mosaic Shop, the purchaser’s sole and exclusive remedy shall be limited to either the replacement of the material in question or a refund of the purchase price for the affected material, at the sole discretion of The Mosaic Shop.
21
Delays and Force Majeure
The Mosaic Shop shall not be responsible for delays caused by circumstances beyond our reasonable control. These may include transportation disruptions, labor disputes, natural disasters, supply chain interruptions, customs delays, pandemics, or other force majeure events.
Orders may also be delayed until required documentation and payment authorization have been received and confirmed.
22
Governing Law
These Purchase Terms and all transactions with The Mosaic Shop shall be governed by and interpreted in accordance with the laws of the State of Florida.
Any dispute, claim, or legal proceeding arising from or relating to purchases made through The Mosaic Shop shall be brought exclusively in a court of competent jurisdiction located in Naples, Collier County, Florida, and the parties hereby consent to the jurisdiction and venue of such courts.
23
Policy Acknowledgement and Agreement
By placing an order through The Mosaic Shop, the purchaser confirms that they have reviewed and agreed to these Purchase Terms as well as all related policies published on this website, including the Shipping Policy, Return Policy, and Installation Guidelines.
